Article 1 - Applicability
These sales conditions apply to all tenders, orders and agreements of ‘t Hofbrouwerijke BV, located at Hoogstraat 151 2580 Beerzel, hereinafter referred to as “the brewery”. Deviations are only valid if agreed in writing.
Article 2 - Orders and agreements
All offers are without engagement and subject to availability.
An agreement comes into effect after written confirmation by the brewery or as soon as the execution has started.
The brewery reserves the right to refuse orders without giving reasons.
Article 3 - Prices and payment
All prices are exclusive of VAT and other taxes, unless stated otherwise.
Payment should be made within the agreed term. In the event of late payment, the customer shall by law and without notice of default owe interest on arrears at 15% per month.
Collection costs shall be borne by the customer.
Any discounts are one-offs and confer no right to future benefits.
Article 4 - Delivery and retention of title
Delivery deadlines are indicative and not binding. Exceeding the deadline does not entitle the customer to compensation or cancellation.
The brewery remains the owner of the delivered goods until full payment has been received.
The risk of the goods passes to the customer upon delivery.
Article 5 - Complaints and returns
Complaints about delivered products should be made in writing within 48 hours of receipt.
Return shipments are only possible after written approval by the brewery and must be in original condition and packaging.
Article 6 - Liability
The brewery is not liable for indirect damage, consequential damage or loss of profit.
The brewery's liability is limited to the invoice amount of the delivery concerned.
The customer indemnifies the brewery against claims from third parties in connection with the delivered products.
Article 7 - Force majeure
In case of force majeure, including but not limited to natural disasters, strikes, governmental measures and pandemics, the brewery has the right to terminate or suspend the agreement without damages.
Article 8 - Applicable law and disputes
These conditions and agreements are governed by the law of Belgium.
Disputes shall be settled exclusively by the competent court at [Place].
Article 9 - Changes
The brewery reserves the right to amend these terms and conditions of sale. The modified conditions shall apply to new orders from the date of publication.
